Back in September, I proposed an amendment to the U.S. Constitution that would allow for the 50 State Governors to overrule all legislation of Congress, policies of The President of the United State and decisions of The Supreme Court.

But given the state of government under the Presidency of Barack Obama and leadership in Congress under Nancy Pelosi and Harry Reid, I have come to the conclusion that the ONLY way to curtail the Federal Government is to require all legislative acts of Congress, policies of the Executive Branch and decisions of the Supreme Court be subject to the same strict standards of amending the Constitution itself.

That is - require 2/3rds vote for passage of any legislation before both houses of Congress. And then every legislative act of Congress would require ratification of 3/4 of all the State Legislatures!

Policies proposed by the Executive Branch would also require ratification of 3/4 of all State Legislatures!

Decisions of the Supreme Court would (somehow, I confess I don't know how) also require the ratification of 3/4 of the State Legislatures to have any meaningful effect.

I suggest these amendments to the Constitution to curtail and rein in the over-reaching Federal Government and return rights and powers to The States and to The People.

I'd appreciate any other suggestions.

You have been emailing me frequently as of late. While I share the same concerns you express in this email, I cannot help but respond that but for you we may not be in the position we find ourselves in with a Marxist sitting in the White House and many Marxists in Congress.

For too long politicians in the Republican Party have chosen to "get along with" and work with Democrats, liberals and Marxists. All the while these Democrats, liberals and Marxists have sought to demonize, marginalize and destroy Republicans. Democrats, liberals and Marxists control schools and unions in America. I could care less that you feel you were deserving of the Presidency for all the years of service to your country! Unfortunately, every time the Democrats put forward candidates for President that are (relatively) young, (relatively) good looking and dynamic, Republicans counter with some old curmudgeon who can barely walk much less inspire and arouse the electorate. Next you decided you wanted to "reform" our immigration laws. To this day, Americans (those of us that are here "legally") wonder - What exactly is it that is wrong with our immigration system that is broken? Other than the fact that the Federal Government does little to nothing to stop people entering our country illegally, find them and expel them! This appears to me to be a problem of the Federal Government needing "reform". That would be my solution! "Reform" the Federal Government to get it to actually enforce THE LAWs already on the books!! Your solution? Simply allow the people that have entered our country illegally some "mechanism" (euphemism) for them to "normalize" their "status" and remain here!

There are only 2 reasons I voted for you in the last Presidential Election - That you were NOT Barack Obama and Sarah Palin.

Thank you for introducing America to Sarah Palin. For my purposes, that's about all you've given me as a Conservative and a Republican. For the simple fact is - you gave us a Barack Obama Presidency.

Much has been written recently about the number of words in Pelosi's Health Care proposal. Nearly 2,000 pages and around 400,000 words.

Here are 47 words from the U.S. Constitution with which to compare:

 "Section 1.
Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.

Section 2.
Congress shall have power to enforce this article by appropriate legislation."

With the inclusion of "Mandates" on private citizens in Nancy Pelosi's Health Care proposal, does this not amount to "involuntary servitude" to service the Federal Government's "Public Plan"? I don't wish to purchase insurance - Government or otherwise - and the Federal Government will fine me? The Baucus Senate version of ObamaCare even has the stipulation that should I continue to refuse to purchase health insurance, I stand to go to jail!

Does my Government serve me? Or do I serve the Government?

Nancy Pelosi never fails to dazzle us with her brilliance! Perception is reality for Democrats, so she decides that the best way to get the American people to support Democrat's "Public Option" is to rename it the "Competitive Option".

As if!!

What would Nancy Pelosi know about "competition" anyway? She lives in a pretty safe district for her re-election chances. She and her Democratic (I'm sorry, "SOCIALIST") colleagues assail private business at every turn. Private health insurers earn as low as 2 to 3% profit on the policies they carry and yet that is too much for the SOCIALISTS in Congress.

These "Pelosi-istas" in Congress have for years railed against unfair business practices. They wield Anti-Trust laws as an axe over the heads of Big Business. In May of 2008, Maxine Waters told oil company executives she compelled to testify before her committee on high gasoline prices, "Maybe the Government should take over and run your companies".

Perception can be reality. But most conservatives in America realize Pelosi's name change for what it is. A cynical ploy using Orwellian "news-speak" to fool her fellow fellow-travelers.

These fellow-travelers rail against big business "monopolies". And yet it's perfectly fine for them to create and run one themselves. For that's all this "Public Option" or "Competitive Option" really is.

A Federal Government monopoly.

Mikhail Kalashnikovon his invention, the AK-47: "When a young man, I read somewhere the following: God the Almighty said, 'All that is too complex is unnecessary, and it is simple that is needed'".

You would wish the Democrats in Congress would heed these words when it comes to Health Care legislation.

But no.

Rahm Emanuel tells CNN that that Fox is "not so much a new organization as it has a point of view". Funny.  I have a similar opinion of Barack Obama.

Health Care Talking Points: Size & Scope

Why over 1,000 pages? Sure, there are issues with health care that can be improved – tort reform, portability, pre-existing conditions, and so forth. But liberals always seem to believe they need to “reform” whole sectors of society or industry to fix a few problems. A thousand pages or more??

John Conyers (Democrat from Michigan), Chairman of the House Judiciary Committee, publicly asks the rhetorical question, “What good is reading the bill if it’s a thousand pages and you don’t have two days and two lawyers to find out what it means after you read the bill?”

First of all, for what other reason is this man in Congress - if it is not to write, read & vote on legislation? And if he is to vote on legislation, he has an obligation to read it!  And understand it! He took an oath to “uphold the Constitution of the United States” and he fails in his oath if he should not read the legislation on which he is voting. He has an obligation to his constituents to read and understand the legislation on which he is voting and which would then become the law. John Conyers’ constituents would be subject to the terms of this legislation which would become the law! John Conyers’ constituents would not be allowed a similar defense. “Ignorance of the law is no excuse” is pretty standard law of the land.

Secondly, if John Conyers would require “2 days and 2 lawyers” in order to understand the legislation, what are the average citizens to do?  What are the doctors to do?  Or even the bureaucrats who would have to administer the law? Do all citizens, doctors and bureaucrats need to “lawyer up”? Will I need to consult with a lawyer before selecting a health care plan?  Will I need to consult with a lawyer prior to selecting or visiting a doctor?? The proposed Health Care legislation unders consideration in Congress contains no provisions regarding tort reform. The legislation seems to be quite the boon (a “stimulus”) for the legal profession.

Consider this. Have you even had a question about your taxes? And have you ever had to call the IRS or consult with a CPA with a tax question? It is likely you have. It is also just as likely that you have received different interpretations of the U.S. Tax Code for every different individual you consulted. It is likely that you didn’t receive one single correct answer.

What do you think the chances are that John Conyers was somehow involved in the drafting and passing of the U.S. Tax codes??

But why should John Conyers worry about retaining his job as a Congressman? His constituents probably can’t read their ballot without “2 days and 2 lawyers”.

He he he!!  The Three "O's". Obama (Barack Hussein), Obama (Michelle) & Oprah (Winfrey) could not  deliver! FAILED at bringing the Olympics home to Chicago!

Roman Polanski is arrested in Switzerland after 32 years on the run from American justice. His "peers" in Hollywood race to his defense and decide that he should be released and exonerated not for his offense, but for who he is!

This demonstrates to me (as someone who has worked in the film and television business) that Hollywood personalities no longer consider themselves mere "stars", "super-stars", "mega-stars" or "celebrities". It is clear to me that they have elevated themselves to a status far above we earthly mortals.

By their own estimation, they are our new Gods!

Untouchable and immune from the same justice and moral obligations by which the rest of us are bound, their "artistry" and "achievements", "awards" and "Box-Office receipts" afford them status whereby they may kill (O.J. Simpson), steal (Randy Quaid & his wife), cheat on taxes (Wesley Snipes), assault (Russell Crowe), verbally abuse (Christian Bale) and offend (Kanye West) others with few if any consequences.

How dare we mere mortals hold them to account for their misdeeds and crimes? We are "the little people" who are expected to pay them homage and obedience. Fealty and respect. After all, we worship them, do we not? We ought to bend at knee to the new Mt. Olympus - Hollywood.

It is likely that most of the new "Gods" are atheist in the traditional sense. After all, how could God have attained the same stature of Hollywood celebrities.

I have watched Glenn Beck's program with great interest. He has called for 56 Americans to reshape America as did the original 56 Great Americans that crafted and adopted the Constitution.

My idea for reshaping America and restoring sovereignty and liberty to the States and individuals is a Constitutional Amendment to establish the 50 Governors of the United States the power to overrule decisions of Congress, the President of The United States and most importantly the Supreme Court of the United States. This power vested in Governors would re-establish the original concept for the United States as just that - United "States". This would curtail overreaching power of the Federal Government.

The Governors could convene as a Constitutional Oversight Body on the vote (for instance) of 1/3 of the Governors when it is perceived that either branch of the Federal Government has exceeded its Constitutional bounds. Or The Governor could be required to meet biannually. The Governors could receive all the legal advice they require - arguments for and against -  but would have the power to decide if any branch of the Federal Government overstepped their authority under the Constitution of the United States and reverse the decision (by 2/3's margin perhaps?).

If, for instance, the Supreme Court rules (as they did in Kelo) that private property can be taken by a local and/or State government for the sole purpose of increasing tax revenues for that local and/or State Government, then the 50 Governors Constitutional Oversight Body can vote to overrule the U.S. Supreme Court! If the Supreme Court suddenly decides that the death penalty is unconstitutional, the Governors could convene and reverse such a decision. If a Federal Judge orders a halt to the delivery of water to California's San Joaquin Valley in order to protect a 2" endangered fish while destroying the businesses and livelihoods of tens of thousands of Californians, then the Governors can convene to overturn such a decision.

If Congress passes legislation to give the Federal Government complete control (for instance) of the American Health Care System, then the 50 Governors can convene to vote whether to overrule Congress. If Congress passes legislation (such as the Consumer Product Safety Improvement Act) that cripples the economy with the unintended consequences of the act, then the Governors could convene to overrule the Act of Congress if deemed to be beyond the powers of Congress under the Constitution. The Governors could at any time block or reverse Congressional mandates that rob the States of their sovereignty.

If the President of the United States assumes powers not vested in him by the Constitution - as in firing the CEO of a privately held company or transferring trillions of dollars to "banks to big to fail" - then the 50 Governors could convene to overrule the President of the United States.

The Governors should be given the power of oversight of Congressional budgets!

This mechanism of Constitutional Oversight by the 50 State Governors would:

**Restore State sovereignty and power.
**Restore the power of Governors - currently not much more than lapdogs to the Federal Government.
**Restore power to The People as Governors are elected by ALL State citizens, not just some legislative districts. Governors are more accessible and responsive to their electorate.
**Restore power to The People in that Governors (in many States, such as California) can be recalled by their voters. Or The Governors can simply be replaced at the next available election.
**Constrain and control the out-of-control Branches of the Federal Government
**Remove from the Supreme Court the power of Judicial Review. The Supreme Court assumed this power early in its existence and has never been successfully challenged. The Supreme Court would be relegated (as some suggest it was intended) to simply be the ultimate arbiter of legal fact in cases of law and legal disputes - not to judge the Constitutionality of Acts of Congress or The Presidency.

My logic for this system comes from the U.S. Constitution itself. The Presidential Election was marked by confusion and conflict over the Electoral College. But what is remarkable is how the framers of the Constitution established the means of electing a President. It is not the popular vote that elects the President!  It is the States!! Without the Electoral College, no candidate would campaign in Wyoming!  Or South Dakota! Or Idaho! What would be the point? They don't have much in the way of population! All candidates would do is campaign in the population centers of the East and West coast, Texas and the area around the Great Lakes!!

With the adoption of the Electoral College, the framers of The Constitution were clearly establishing the supremacy of The States!! Presidential Candidates must campaign in small population States that are crucial for their Electoral votes! The Constitution gave States the authority to elect presidents! The Constitution prescribes only that "States shall choose their Electors" to the Electoral College. There is no requirement at all in The U.S. Constitution for a "popular vote" to elect The President of The United States!! State Legislatures could select Electors to the Electoral College with no requirement for a popular election!

The State Governments under the Articles of Confederation were reluctant to surrender powers and authority to the Federal Government under the Constitution of The United States! They had to be persuaded to the benefits but all the while suspicious of the Federal Government assuming too much power. Why would any State government willingly surrender their powers under the Electoral College and accept Presidential election results based on the popular vote??

Now we find ourselves living what The States at the time of the adoption of The Constitution of The United States most feared - an all too powerful Federal Government assuming powers not delegated to it under The Constitution of the United States.

The President of the United States, Congress and The Supreme Court are all assuming too much power and depriving The States and individual citizen’s rights and powers guaranteed under The Constitution of The United States.

It's time to take our Country back!

So, may I suggest to you a Constitutional Amendment (perhaps a Constitutional Convention to achieve it) establishing the Governors of all 50 States with the power to overrule all branches of the Federal Government to adhere to The Constitution of The United States.

Oh, believe me. I know precisely how some are going to react to THAT blog title. The Jeneane Garofalo's in our country would have everyone believe that conservatives only criticize Barack Obama because he is black.  Oh, wait!  He's HALF black!!  And half white!  Which side am I supposed to hate again??

Now everyone's favorite former President has weighed in! Americans criticize Barack Obama only because we are racists!!  And yet we can't admit to this, so we deviously couch our criticism in code words - liberal, socialist, excess spending, budget cuts, blah, blah, blah!!

I'd like to ask Jeneane Garofalo and Jimmie Carter something. With blacks (okay, "African-Americans") comprising about 12% of the nation's population, how was it possible that Tom Bradley was elected the first black mayor of Los Angeles? And how was Maynard H. Jackson Jr.elected the first black mayor of Atalnta? In the "racist deep south"!! Again and again you can find instances of blacks (okay, "African-Americans") being elected to positions of government whether in black-dominated districts or mostly white districts. Finally, Americans elected it's first black (Dang!  I keep forgetting!  "African-Americans") President of the United States!

With 12% of the nations population being black, can the "black community" on it's own vote these individuals and even the President of the United States into office?? Obviously the answer is no!!

You need WHITE people to elect these black politicians to office!! You need WHITE people to elect Barack Obama to the Presidency of the United States!

Jeneane Garofalo and Jimmie Carter would have us believe that we still live in the 1950's and force black people to the back of the bus and make them enter hotels through the back service entrance. But the reverse is true!  White people have come a LONG way since the 1950's. Black and white people work side by side in offices, factories and warehouse all across the country! Black and white people live in the same neighborhoods. Black and white people are friends and even marriage partners (can you say Barack Obama's parents??) White people work for black people and vice/versa!

And white people VOTE for black people!!  If Michael Steele had been the Republican candidate for President running against Barack Obama, there is NO QUESTION I would have voted for the man!  I would have voted for Michael Steele over ANY white Democrat! I'll take Larry Elder or J.C. Watts or other illustrious black conservatives over Barack Obama or any white liberal Democrat!

If Barack Obama can fire the CEO of General Motors, he sure should be able to fire Bertha Lewis, The Chief Executive of ACORN! ACORN has received something in the neighborhood of $54 million in ta-payer funds and stands to receive 8.5 BILLION more!  If bailing out GM gives Obama the grounds by which to fire Rick Warner, he certainly has the same rational to fire Bertha Lewis!

What Hannah Giles and James O'Keefe have revealed to us about the inner workings of ACORN is almost beyond belief.

But what troubles me even more is this: Without the presence of hidden cameras, what similar activities has ACORN facilitated??!! What similar activities have they had full knowledge of, participation in and accommodated??

Has ACORN successfully found housing for other prostitutes?? Have they successfully prepared their taxes as "performance artists? Have they accommodated other requests?  Have they assisted people in establishing crack houses??  Meth labs? Have they prepared tax returns for those "services" and "businesses" as well??

James O'Keefe and Hannah Giles have revealed what most certainly can only be the tip of the iceberg! As citizens, we all need to demand that Federal, State and local officials investigate this organized criminal enterprise and put an end to it.

If Charlie Gibson and the rest of the (so-called) media can stop laughing long enough (as he laughed in a recent radio interview when he admitted he knew nothing about this story), maybe they might find a story dropped in their laps. A story that might bring down the powerful.

I just watched the video of the San Bernardino Acorn personnel advising undercover "prostitute" and "p__p" Hannah Giles and James O'Keefe. Not only is Charlie Gibson completely ignorant of this expose (laughing in a radio interview that this is something "for the cables"), but where is Barack Obama on the issue?  The U.S. Senate votes 83 to 7 to cut Federal funding to Acorn, but where is Eric Holder?

Acorn has clearly shown it's dirty little secret as a criminal organization.
